Evaluation can be used where the parties need a written finding on specific key issues that are stalling negotiations and preventing settlement of a dispute.

Evaluation can be arranged as part of a mediation, or just as a stand-alone solution and is a very effective alternative

to issuing court proceedings to resolve issues.

It can be for any manner of issues, including liability, valuations, technical or legal differences, disputes over facts, expert evidence or other issues.

The evaluation is given by someone of the parties’ own joint choosing. InterResolve helps arrange all this.

InterResolve as a Neutral ADR Advisor

The parties need careful assistance with these options and InterResolve is there to work between the parties and their advisors to assist with agreeing:

  • The method they wish to use

  • The narrowing down of the issues to be put forward for an evaluation

  • The terms of reference for the evaluator

  • The identity of the neutral person to give the evaluation (independent judge, QC, expert or other) and making sure they are acceptable to all sides

  • Agreement of evaluator’s fees, appointment and publication of the evaluation
