InterResolve has developed the Injury Claims Charter to assist insurers who face third party indemnity exposures for injury compensation. The Charter sets out the basic principles of conduct under the Direct Settlement® process while protecting the interests of claimants and insurers. Claimants benefit from a simpler and faster settlement that avoids unnecessary legal processes unless the claim is disputed or medically complex. All claimants have access to free private medical care and independent advice on the value of their claim. Signatories to the charter can decide on a claim-by-claim basis which claims they wish to settle under Direct Settlement®.
Claims costs are reduced by an estimated 30% compared to MoJ fast track costs, with average savings of hundreds of pounds per claim. Savings are made on claims costs by removing legal costs, damages awarded to claimants are never affected.

Direct Settlement® reduces claims costs by circa 30% compared to the equivalent MoJ fast track costs and provides certainty, as all claims are invoiced at a fixed fee. Unlike the MoJ process, Direct Settlement® has no staged costs, and all fees are payable only upon settlement. Before being presented to the insurer, all claims are risk assessed for suitability and every claim is screened for fraud using various industry databases and automated processes. Insurer handlers then have a fixed time window to decide on a claim-by-claim basis whether or not claims will proceed under Direct Settlement®.
Claims are run electronically using the InterResolve Portal which simplifies the claims process and reduces the input required from claims handlers. Using the portal, claims can be securely referred and their progress tracked and monitored. Users can also view claims evidence and documentation, communicate directly with InterResolve, make and adjust case reserves or settlement offers as appropriate and get priority access for management staff. The portal is secure and accessible from any internet browser. Integration and web services to reduce data entry are also available.

InterResolve provides bespoke Management Information at a frequency agreed with insurers. The MI can include conversion and early settlement rates, average settlement times, cost savings against agreed benchmarks and general volumes & statistics (to be specified and agreed) to enable insurers to closely track our progress.

Claimants are treated fairly and ethically and offered a choice, allowing claimants to avoid the usual delays and frustrations of an extended legal process and reach settlement faster. Claimants are provided medical care, free independent damages assessment, legal advice (where required) and early mediated settlements.
Claimants are also offered, where preferred, an almost paperless journey. Documentation can be signed using electronic signatures, and claimants can track the progress of their claims online.

Following collation of the required medical evidence, we provide claimants with an early independent valuation of their general damages claim using an automated valuation tool. The Medical Report and valuation is commissioned for the claimant and is included within the Direct Settlement® fixed fee, providing safety and comfort pre settlement for both the injured party and insurer alike.
Claims that do not settle under the principles of the Injury Claims Charter will be referred to our panel solicitors and will proceed through the MoJ process as usual.
Direct Settlement® is designed for the vast majority of small claims that are admitted and do not require an extensive medical intervention or legal support. Disputed or complex claims are referred to a solicitor for representation by agreement with the claimant and insurer.
